You do have the right to be reimbursed for your out-of-pocket expenses as well as your co-pays, assuming there’s the correct insurance in place that will protect you. The two places we look for insurance for purposes of reimbursement is, number one, bodily injury or liability insurance of the at fault driver. The second place we look is under-insured or uninsured motorist coverage.

Both of those coverages are not required in the State of Florida. However, they are extremely important. That’s why we recommend all of our clients get uninsured or under-insured motorist coverage just for that purpose, to make sure that you’re reimbursed and also to help pay for any additional damages that you have.
