If my seatbelt was not buckled when the driver of the car I was riding in caused an accident that injured me, can I sue for damages?

If your seat belt is unbuckled during an accident you still have the right to sue for damages. When it comes to the use of seat belts in the state of Florida, it basically comes down to an issue of comparative negligence, or percentage at fault. Although not wearing a seat belt could put a percentage of the cause of the accident on you, or I guess more importantly a percentage of your injuries on you, there still could be fault on the other driver, the driver that caused the accident. As a result, you still have a claim.
