Do I have to give a recorded statement to the insurance company in a car accident case?

In order to answer this question we have to look at which insurance company is actually requesting the statement. If it’s your own insurance company, you may be required to give that statement because you actually have a contract with your insurance company through the policy that requires you to not only cooperate but also give statements whether it’s for PIP or Liability when they request it. If the request is coming from the adverse party or defendant’s insurance company, then typically you’re not required to give that statement because you don’t have a contract with them. Therefore, they can’t force you to.
