Can I control whether my car is repaired or replaced following a Florida car accident?

After a car accident in the state of Florida typically victims have very little control over whether or not they can choose to repair their car or have it replaced. Basically, what Florida’s done is they’ve set up a minimum-maximum amount of damage that can be caused to the vehicle to determine whether or not it’s a total loss. That percentage is actually 80%, so if you take the total value of the car and the amount of cost that it would take to repair it exceeds 80% then by law that vehicle will automatically be a total loss and it will not be repaired.
